By using SH services or software, any customer, employee or third party unconditionally accepts this Policy.
SH reserves the right to modify this Policy at any time to stay in compliance with any laws, regulations and security requirements.
SH reserves the right to suspend or cancel customer's access to any or all services or software provided by SH when SH decides
that the account has been inappropriately used.
SH reserves the right to delete any content that SH considers to be unappropriate or if SH are legally required to do so.
Your use of the SH services or software is at your sole risk. The service or software is provided on an "as is" and "as
available" basis. SH expressly disclaims all warranties of any kind, whether express or implied, including, but not limited
to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
SH makes no warranty that the service or software will meet your requirements, the service will be uninterrupted, timely,
secure, or error-free, the results that may be obtained from the use of the service or software will be accurate or reliable,
the quality of any products, services, information, or other material purchased or obtained by you through the service or
software will meet your expectations, and any errors in the software will be corrected.
Any material downloaded or otherwise obtained through the use of SH services or software is done at your own discretion
and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the
download of any such material.
The SH Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation
of any applicable law or regulation coming to or from any unauthorized network or system is prohibited. This includes, without
limitation, material protected by copyright, trademark, trade secret or other intellectual property rights used without
proper authorization; government and military data protected by law and national security; university and academic data
protected by public policy; and material that is obscene, defamatory, constitutes an illegal threat, or violates export
control laws. Any violation of the above, which compromises the integrity of the SH Network or any other network, is strictly
prohibited.
Tortious conduct, including but not limited to posting of defamatory, scandalous, or private information about a person
without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual
property rights. Any violation of the above is strictly prohibited.
Violations of system or network security are prohibited, and may result in criminal and civil liability. SH will investigate
incidents involving such violations and may involve and cooperate with law enforcement authorities if a criminal violation
is suspected. Examples of unlawful acts, system, or network security violations include, without limitation, the following:
Unauthorized access to or use of data, systems or networks, including any attempt to probe, damage, scan or test the vulnerability
of a system or network or to breach security or authentication measures without express authorization of the owner of the
system or network. Unauthorized monitoring of data or traffic on any network or system without express authorization of
the owner of the system or network. Interference with service to any user, host or network including, without limitation,
mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Unauthorized access to any data,
system, or network from an unauthorized system or network for any purpose which is not lawful or which is intended to do
harm. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting. Electronic
forging of any kind to include but not limited to IP addresses, domains, business names, etc.
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements,
is explicitly prohibited.
A user shall not use another site's mail server to relay mail without the express permission of the site owner.
Accounts are to be used by the primary owner only. Customers are not permitted to subhost including reselling, storing,
or giving away web hosting services off of their web site to other parties. Subhosting is defined as allowing a separate,
third party to host content on the owner's web site. Exceptions include ad banners, classified ads, and personal ads.
Setup fees are charged for some new accounts and are non-refundable. All pricing is guaranteed for the term of prepayment.
SH reserves the right to change prices at any time. Any account not brought current within a week of email notice or exceeding
this time frame in any way is subject to suspension. Service fees will accrue during any period of suspension. The customer
is responsible for all money owed on the account from the time it was established to the time that the customer notifies
SH in writing of a request for termination of services. Checks returned unpaid (NSF) will be assessed a $30 charge. All
payments are in U.S. currency.
SH reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and paid
by SH if SH institutes its right of cancellation. If cancellation is caused by a customer's violation of these policies,
then no refund is due. Customers can cancel service any time and be refunded any amount exceeding the prepayment of the
current month. The customer is responsible for all money owed on the account from the time it was established to the time
that the customer receives confirmation by email that the cancellation request by letter, fax or via online form, has been
received and processed.
The customer agrees that it shall defend, indemnify, save and hold SH harmless from any and all demands, liabilities, losses,
costs and claims, including reasonable attorney's fees asserted against SH, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer,
its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless SH against liabilities arising
out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with SH's
server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
(3) copyright infringement and (4) any defective products sold to customer from SH's server.
Disclaimer
SH will not be responsible for any damages that customers or their enterprises may suffer. SH makes no warranties of any
kind, expressed or implied for services it provides. SH disclaims any warranty or merchantability or fitness for a particular
purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions
caused by SH and its employees. SH reserves the right to revise its policies at any time.
